This blog has many great things within the pages that make it an online presence. While my tweets are a tiny window into my world, this blog gives one a more consistent stream of thought. I typically will talk about what is on my mind or encourage you to go check out this book or that one that I have either edited or just released. In short, it is a marketing tool, and I am upfront about it. It is also a way to communicate with me and I you.
As an independent author, we have to get it all right all of the time to maximize our penetration into the marketplace. That is a fancy way of saying we all need representation by someone who does this part of the job for a living.
As a writer we are creative. Some of us have some acumen in other areas but, truthfully to be a good writer our focus needs to be in the creative process. I have had a modicum of successes with my 25 existing novels, so I cannot complain and I won’t.
Tonight I was going to take a break from my usual activities in front of the computer. I was going to watch a DVD. I put the DVD into the machine, and of course, it sucked it inside. The process of the typical movie routine started out when I was actually looking at the screen.
You usually are forced to watch commercials for up and coming shows. Those are the times you make the popcorn, put the dog out one last time, or turn the phone off.
Up on the screen, there is this FBI warning. Have you ever read that? Between this FBI warning and the Interpol warning one has to wonder, do I really want this stuff in my house? If you agree with all that stuff just by playing the movie, what can they do?
When you go to the airport, you agree to give up many of your rights while you are behind the “security line.” That to me gives me reasons for anxiety. We give up control when we enter the airport.
I have been flying for many years. When I started flying you dressed up to fly. It was a big deal. The flight attendants were stewardess’s and very attentive.
In some airlines, I do feel like my privacy has been invaded and truth told the TSA has groped me. “They put their hand up till they meet resistance.” “How about a broken nose, would that constitute resistance?” It is either be groped or be seen naked by god knows who in some faraway room where they look at thousands of naked people every day.
It is just not the airport or the DVD’s where we submit to something it is also on the very software you are using. Apple and Microsoft have End User Agreements that are mind numbing!
The other day I heard on the radio that some software company had put in their End User Agreement a clause that if you agreed, you were supposed to come and clean out their toilettes. To their point, nobody reads that shit! The end user agreement is pages of boilerplate that basically takes your rights as a consumer away and protects the maker of the software.
“If you don’t agree, click here!”
“I bought the damned software so now what am I supposed to do?”
You must agree that they hold all of the aces and you have nothing. You don’t even own the software that you bought. You have a license to use it. That is what they are really selling now.
On DVD’s you have a license to watch it in the privacy of your own home. By law, you cannot legally play it where others might see it or hear it. How many times have you either had people over or been over to someone’s house and watched a movie? Yep, you broke the FBI Interpol whatever the hell law. Can you imagine bringing some film to church to entertain the kids and the FBI comes in with guns drawn to take you down! Yes, we need to arrest you and all these kids here because you are not licensed to play this movie in public.”
If you are a satellite XM subscriber as part of your yearly fee you are paying royalties to listen to whatever you are listening to. Who knows how much of that royalty fee actually goes to the artist.
If you are playing your radio and others hear it, you are violating some rules regarding your personal use only. The laws are unenforceable, but they are there none the less. As a business, if you put music on your on hold phone system you are to pay money to some organization that protects the artist.
I know because they contacted me and threatened a lawsuit if I did not send them $1,100 a year. I told the company that I would not pay, but since it was their company and I was but an employee, they paid up. It is extortion, and it worked.
My novels have been pirated. One of my books is on some foreign website translated into a language I do not recognize and being sold by the thieves and I am not making money from it. If you google yourself or your titles you might be surprised. Since I cannot even make out the language what am I to do?
I took it as a compliment that they thought the book good enough to pirate. FFS!
My tweets were even hijacked, and my web address crossed out, and someone else’s put there. Is the FBI going to go after the perpetrators? Software manufacturers see this all the time. For that matter, there are places I am told that you can download the latest movies for free. As a writer, I would never do that. As a writer, I see what they are dealing with from their side of the fence. I used to record songs from the radio, on to 8-track tape… That was obviously before CD’s, and digital quality came about. Now I can tell you that I usually bought the Cassette tape or the vinyl LP of the artist that I liked. I still have Foreigner on 8-track, cassette, and LP…and of course CD. LOL
Admittedly, many of my movies come from the Walmart bargain bin, and some come as gifts, but I don’t have time for even them. With cable, Amazon Prime and Netflix there are not enough hours in the day to be entertained by the TV.
Satellite radio is one of the few things I use the most. Currently, it is sitting on the holiday station which of course is old Christmas music.
Watch what you agree to. Read the fine print if you don’t want to end up cleaning toilets somewhere. This subject is a good place for the consumer protection agency to step in and force the simplification of those agreements that we are all forced to agree to. Tens of pages of 4 pt type are, can we say this “bullshit!”
